Q: I'm a widow an I was told I couldn't get no benefit because we want marry long enough?
A: I am sorry for your loss. I can't tell from your question what benefit you are trying to collect. Assuming wrongful death, the issue is one of damages. A long term, happy and stable, marriage represents a bigger financial loss than a new, untried, marriage. A wrongful death suit is about money, not about your personal or emotional loss. I am also assuming that you were asking the lawyer to take on the case on contingency? Depending on the facts of the case, most lawyers are not going to take a case on contingency unless there is a good chance of recovering their costs, which means the case has to be worth $10,000 or more to be cost effective. There are not a lot of facts in your post, so I am making assumptions. You should meet with an attorney for a second opinion.
A: Unlikely if you were legally married, before a duly authorized person. If you are talking common law marriage--that's way different.. Contact a member of the North Carolina Trial Lawyers Assn/Assn for Justice.
