Q: Can I use a convo with my ex recorded in Alaksa for a hearing in Florida? Both parties were in Alaksa when it happened.

I recorded a convo with my ex when she lived in Alaska. We were both in the state of Alaska and I did not tell her she was being recorded. Can I still use that against her even though I live in Florida?

A: Technically recording such a conversation is legal in Alaska. It may not be in Florida, and it may be hard for a Florida judge to stomach admitting something that would be illegal in his state. It's also risky to use such recordings in court - it makes you look bad. The best approach is to let your ex know you have the recording, and then have him/her testify or appear at a deposition and ask him/her about the same subject matter under oath. If he/she lies, then perhaps using the recording to expose the perjury would be justified. You really should consult a Florida lawyer before using the recording in any way.
