Q: MILITARY / UCMJ QUESTION If a sailor is found guilty of a charge in a general court martial, and handed a NO punishment

sentence by jurors that had the option to reduce rank and/or take away frocking... Is NAVPERS (without referral or request by sailor's command) authorized to withhold advancement in respects to rank?

Incident occurred & investigation in 2009 when Sailor was E6

Frocked to E7 in 2009

Promoted to E7 in 2010

Indicted 2011

Frocked to E8 08/2012

Convicted of charge (sentence: NO PUNISHMENT) 09/2012

NAVPERS decision to withhold advancement 06/2013
