Q: May I file a theft complaint against the staff of a closed, locked facility which has video surveillance?
My clothing was stolen from the wash room which has two cameras watching, one of them an infered night / dark unit. I bring the theft of my item to the staff, and then to the director, all who totally refuse to review the recorded tapes showing exactly who it was who stole my $160 coat.
My question is being that they know, and / or have the ability to know who it was who stole my coat in this closed, locked facility, doesn't that make the staff and director, accessory to the theft under ORS 161.150?
A: Unless the facility was actively a participant in the crime, no. Also, keep in mind that sometimes cameras are for show and are not actually working or recording.
