West Danville, VT asked in Uncategorized for New York

Q: We have a legal question about a neighbor on whether we should report it to the police or not.

We have a legal question about a neighbor on whether we should report it to the police or not. We go away for the winter, our home is locked up. We have a deeded shared well with our neighbor, the neighbor sent us a message online after they broke into our basement as they said they heard water running, they stopped the water. Now she is saying she had to replace the pump that we had done last year, but the pump was pumping fine she says when she heard the water, we asked for a bill, have not heard from her in at least 10 days now. Our main concern now at this point to we report it to the police for breaking and entering, thank you for your time.

A: It depends on whether there is a shared easement for access into your basement since you share a well. Further, it sounds like she may have saved your house from flooding.
