Q: I have a disability discrimination charge at the eeoc,my company was found in violation under title 8 and retaliation.

My company agreed to settlement negotiations , its been nearly a year now and still not finished. I worked for this company for 20 years. How will an attorney serve me in this matter, and also will the attorney obtain most of my settlement.

A: You would be well served to consult with a lawyer. I believe you should have done so early on. A good attorney with experience in employment discrimination matters will greatly improve your chances of success. An attorney should disclose up front what the fee will be. If the lawyer takes the case on a contingency basis, then the lawyer will receive some percentage of any award or settlement. It will not be most of the settlement. A standard contingency is around one third, and that one third is well worth it because you are not likely to do as well without an attorney. Some lawyers may ask more. Even attorneys who are pursuing litigation for themselves will seek legal representation. It is just not wise to represent yourself in these kinds of matters.
