Q: I am a realtor and have my sellers home in escrow with the tenant as the buyer. The seller received a letter in the mail

from an attorney claiming trees on the property have damaged his stucco, concrete, fence and foundation. He has only been in the home a little over a year. He included an aborist bid from 3 months ago. The buyer wants this resolved before close but they have not filed any suit - just sent this letter. What are my sellers options? His insurance said not to open a claim as there is no suit - and that the neighbor should contact his insurance

A: The seller must disclose this issue, but the buyer seems already aware of it, and the seller has the option to not do the work and credit the buyer with the costs or do the work or tell the buyer to take it or leave it.
