As I understand it, you own the property and contracted with a builder to build the house. A defect in the construction caused the damage. You should demand that the builder repair the damage. The builder should have a bond and insurance. Find out the specifics from these and make a claim.
If repairs will take more than 30 days, request an extension from the bank. Or, if you have 30 days from the date of the certificate of occupancy (CO), notify the building inspector who issued the CO, and ask that the CO be suspended pending completion of repairs.
