Q: I have owned my condo for over 20 years. Was just notified that the HOA plans on assessing an additional assessment to

our regular monthly assessment to those owners who rent their units out. I have had the same tenants for over 10 years. When I bought this condo (and several others in different areas) I bought them as an investment to supplement my retirement. I never had any intention of living in any of these condos. This is the first I have heard of this proposal. I never received any info that they were considering this nor have I received any info as an owner to vote on this new policy. Can they legally do this without the owners voting? This seems like discrimination and harassment to me. If I lose my tenant because I have to raise the rent, can I file a lawsuit against them?

A: Yes, the board of the HOA can do that. It's irrelevant how long you have owned your condo. If you want a bigger say then you should attend the HOA meetings.
