Sacramento, CA asked in Arbitration / Mediation Law and Estate Planning for California

Q: Can presiding judge also act as mediator? How to object to judge's ruling and get case heard by a different judge -

Trustee 3 years late in submitting accounting and it's over a year old. Trying to assess all trust expenses to one benef. - property taxes, income taxes, her attorney's excessive atty fees, accounting charges in excess of $4,000 for preparation of taxes, which weren't due but improperly prepared resulting in her paying over $10,000 in taxes, for preparation of the accounting ($2000) and on top of it giving herself 60% of the trust when it was supposed to be 25% except she embezzled which should be subtracted with her receiving nothing. Judge refuses to let me speak - hasn't even reviewed my evidence,.Went to court for court ordered mediation expecting to ask for continuance since trustee was in contempt for failing to provide financial documents. Instead judge had trial without me even being able to speak. I couldn't call my witnesses since I wasn't expecting it. I hadn't finished my discovery. Wasn't ready for even mediation. Judge ruled in her favor 100%. unbelievable
