Q: My mother has been living illegaly in the U.S for more than 15 years, is she qualified to try to become a resident?

Recently we had a court date for driving with an expired drivers license, the judge did tell her that she should try to apply to become a resident. Unfortunately, it's not easy as it sounds. I am 17 years old and I wonder if I can help her when I turn 18.

A: The answer to your question requires more information to be sure, but in general, a U.S. citizen may file an immigration petition for his/her parent when the citizen reaches age 21 (not 18). Another important issue is whether your mother entered the United States with a valid visa or other valid permission, or not.
