Q: Can I sue my NY doctor for malpractice for being misdiagnosed and treated for Lupus SLE instead of Fibromyalgia?
I was treated with Benlysta, plaquenil, methotrexate, etc. since 2013 when I do not have Lupus at all. I have confirmations from several doctors stating that. I was just recently diagnosed with Fibromyalgia.
A: Note that fibromyalgia is not regarded by courts as a recognized illness in some states; further, there is no definitive marker for it such that you can say "if doctor had performed ______test it would have shown." I don't see it but suggest you contact a member of the Georgia Trial Lawyers Assn who handles malpractice cases. Do not discuss these issues on any social media--if you have a case it will mess it up; if you don't and the providers see it they will try to disengage as they will see you as "litigation minded."
