Q: lease says paid in full from july 2015 to july 31st 2016..landlord is trying to make me pay last month
my lease is written it has a start and ending date and it also says the full amount i have paid for all twelve months ..he admitted to his own miscalculation but only after the whole year was up ..now he is demanding the last months rent and threatening me with eviction ...who is at fault and do i have to pay
A: As a general rule, the lease agreement controls over a mistake by a party (the landlord). Combined with the relative bargaining power favoring the landlord, it is unlikely that a mistake by the landlord of a rent payment is legally binding on a tenant. Note, the landlord can still sue you, but the landlord's claim appears very weak from you facts.
