Q: Hit/run. Attorney- we can go after much more. I ask if I could & gave insur policy and bills.

2 yrs ago I was hit and they drove off. I had #120,000 in bills and was told they would start getting some paid then but never done. After calling me asking for a copy of policy again, it was told they could only ask for 100,000 later that nite, it was 50,000 is the only amount the ins. co. can pay out. Now I have liens and the atty gets his 16,000 +. I get nothing. Can I do anything? Uninsured motorist is what they pay 50,000/100,000. Friends car who gave me permission. no one with me. And, I ask him during the first meeting. I could file a claim for 50,000 but if I hire you could I get more and showed 76,000 in hospital bills, I was admitted after accident and transfer to another for surgery. Credit is ruined now and not sure what to do. I signed the check for him to put in a trust to pay the liens but what should I have done? AZ accident. They waited 30 days before it had been 2 yr anniver.

A: I don't know if Arizona has "stacking" or if you can add your uninsured motorist, but the problem is that the attorney can only get the coverage the person has on their policy. It could be 25, it could be more.

Question is can he negotiate with health insurers to say you get a third, they get a third, he gets a third? You should walk out with something but some state legislatures give a lot of power to the health insurance to recover, as does Congress with ERISA plans. I hope you will write your legislature to stop these wind falls to health insurance companies.
