A: You have to file a Workers Compensation Claim Form or there is no workers comp claim. If the treating physicians are sending the bills to you and not to the workers comp insurance carrier, you are seeing the wrong treating physicians. The Workers Compensation Claim form should be faxed to the workers comp insurance company for the employer (the company might be self-insured -- like WalMart -- or uninsured, like a school district, so it might go to Risk Management office of your company).

Save the fax transmission report... you might need tha:t to show you send the Claim Form to the insurer and the boss.

Then: a treating physician within the company's Medical Provider Network -- the MPN -- needs to write that the bills being sent to your home are for treatment for the industrial injury, then you provide that report with those bills and a demand to pay those bills with a deadline for payment. OR GET AN ATTORNEY WHO WILL DO THIS FOR YOU ASAP.

A: If you filed a workers compensation claim you need to serve either the Workers Comp insurance carrier or your attorney. The WCI must take care of the bill and if you went as a work related injury the medical provider should know that they need to file a lien and not bill you directly. Consult with a WC attorney for a free consultation. Good Luck!
