Glendale, CA asked in Estate Planning and Probate for California

Q: Mother created Revocable Trust in CA, but died in FL (resident past 3 years). Do I notify CA Probate?

My mother has been living in FL for past 3 years, but created revocable trust in CA in 2013. She passed away 8/02/16 in FL. I am the Successor Trustee and Executor of Will. All property has been deeded to the Trust. Do I still need to notify CA and FL Probate courts?

A: If there is a trust, then there shouldn't be any assets that are in the probate estate. So you shouldn't have to bring a probate petition unless there is some property that is not titled in the name of the trust. However, you will still have to do some trust administration.
