Q: I was hit and my car totaled last month by someone who was involved in a road rage incident with another driver.

The person that hit me was totally at fault, I had to go to the emergency room and I am currently undergoing physical therapy for my neck but I have been able to work. I had sort of expected to hear from the other person's insurance company regarding some sort of compensation for my injuries and inconvenience. Does this happen automatically or must I go through the trouble of finding a lawyer and pursuing a case. Thanks

A: First, be glad they didn't. They'd get you to say something you thought was helpful but that helped them. Do understand that you only get paid after a hassle and at a minimum you need to contact a member of the Tenn Assn for Justice --they give free consultations--to understand your rights. However they only compensate based on medical records and what's in them. They do not compensate for future medical issues or chance of those unless you have a documented permanent /likely to last problem. They do not care one jot what the internet sources say your injury is or will be. You get zero in all 50 states for inconvenience and aggravation. However if it was road rage you may get something additional.

Contrary to the insurance company propoganda, in a car crash you don't get something for not-much.

However they should have paid for damage to your car and if that hasn't been taken care of that would be surprising (& if your company paid you should have received your dedcuctible).

Likewise, if it was road rage and he was charged you may get a victim impact statement from the DA's office if you were listed on the police report.

So definitely grab the free consult.
