A: You need to file a probate petition with the court. You, if you qualify, can be appointed personal representative. Then you will publish notice to creditors, and do the other things which a personal representative is required to do. That, in short, is how title is transferred to you and your sister.

A: If only this land/home is in your father's name and it was his homestead property, you may be able to proceed with a summary administration and petition to determine homestead status of real property to have title transferred to you and your sister.
