Q: My husband was in car accident 3 yrs ago and fractured his spine. Just his vehicle involved.
State trooper asked him a few questions then he was immediatly taken by ambulance to hospital where next day had to have back surgery. Accident happened near brothers house so he came to scene and state trooper issued a citation for failure to maintain lane. He didnt mention this to my husband nor did my husband sign it. It was given to his brother who in turn forgot to mention the citation or give it to us. Did not find out about it til after court date and license was suspended. Now hes in jail for failure to appear. He also was on probation. Is there any way we can beat this? Note: Brother is being uncooperative and wont help.
A: Weird that he'd get a citation and court date but maybe that's how they do it down there.For the ticket and challenging his being in jail you need to make copies of what is at the court as far as what the docket shows. Get in touch with a lawyer that handles tickets and licenses in the county where the ticket case is.Failure to appear may have been for something else.Then move on to the suspension--get the DMV's record for his suspension. See what it involved.
