Q: My wife died without a will. I need to get a bunch of her assets in to my name - can I do this without an executor?

A: There are some limited exceptions to the requirement that a decedent's estate be submitted to probate in order to pass title to the heirs, but if there is real property involved, they would not apply. If a probate petition is filed, you may qualify to be the personal representative (formerly known as an executor).
