Petersburg, VA asked in Employment Law, Personal Injury and Workers' Compensation for Virginia

Q: Great Toe was amputated as result a blood clot formed in my calf. What can I do?

Claim has been filed, but contested. Been out of work now since June 27 2016. No lost wages yet. They responded on July 27th. Further investigation. Nothing yet. I've lost my license because this also, unable to pay. Also Childsupport is enforcing my order under these circumstances. They have a copy of the claim and doctor note, stating no work.

A: Hard to give you a rundown based on missing facts. You should contact a member of the Virginia Trial Lawyers Association who handles workers compensation and malpractice to discuss all aspects of your situation. They give free consultations. Not sure why you would lose your license. You have to ask for a modification of support. In the meantime, apply for medical assistance. You should potentially be able to file an unemployment claim as you are not out of work due to wilful misconduct. But get the consultation, and review all the issues.

A: Virginia WC law requires an accident in order for benefits to be paid or a disease caused by your occupation. You did not indicate what caused your blood clot to form. Without knowing the cause, I could not give you a more definitive answer.
