Q: What legal action can I take against my dentist? She preformed a root canal and broke a file off inside my tooth.

My dentist now refuses to pay for the extra treatment I have to get done now due to her breaking a file off in my tooth. I now have to see a specialist and come out of pocket a tone of money. I did sign a consent form but was never verbally notified that this is a risk. Does this consent form release all liability or not? Please if you can answer and of my questions it would be very appreciated.

A: You would want to contact a member of CAOC who handles dental negligence.They give free consultations. It would depend on what happened, where, and what type of tool was being used, and why it could not be extracted. Possibly a claim could be made against the manufacturer of the file.

The difficulty is that dental cases require expert testimony and that is very expensive; at the same time the verdict value is relatively low. All the best with your dental care.
