Q: oregon - if i want to sue for over $10,000. is it a complaint or a show cause filing?

can i just draw up a complaint and see if the judge will sign it..the evidence from witnesses are already in the public court audio and paper records from the decree from his admission to cheating or do i have to file a show cause to see if i can get a hearing. i want to sue my X for alienation of affection for having a secret life with whores in the marriage for decades that i was unaware of

A: Your ideas on how to do documents for a lawsuit are all wrong. Judge's don't sign complaints. Also a lawsuit for alienation of affection is no longer recognized by the Oregon Courts. In any case, when it was recognized, it wasn't based on the facts you are describing. Alienation of affection was usually a spurned male fiancee suing another man because he interfered with the love of the women involved causing the engagement to end. The inference was that women didn't have control over their own decisions and were unduly influenced by other suitors. It was a demaning concept to women and has been properly abolished.

So if there were still a cause of action like this (which there isn't) you would be suing the other women that got involved with your husband claiming that they stole his affections from you and thus have wronged you. Let's be realistic here. Your husband was not stolen from you - he willing went after other women because, well, he's a cad.

You are understandably hurt and angry and disappointed. Any women would be. But in seeking revenge you are continuing to put time and energy into a person that doesn't deserve your time and energy. You are continuing to allow yourself to be a victim. You only win here if you walk away with your head held up high and don't put any more energy into your ex. Put your energy into counseling, dealing with your emotions, finding out why you would even consider for one second wanting to get back with this type of person or to have any further contact or interaction with him. Work on lifting up your self esteem, which is understandably damaged by this, and get your revenge by moving on and living a long and happy life surrounded by better healthier people.
