Asked in Estate Planning and Real Estate Law for New Jersey

Q: Selling life estate after the death. NJ

My Mom owned a condo in NJ. It was her primary residence. In 2012 she signed it over to my two sons but retained a Life Estate. My Mom lived in the condo until the day that she died in 2015.

My sons want to sell the condo. What do they need to do?

I've read that the death certificate must be filed with the County Clerk. Is that True?

Any and all info and advice is appreciated!
