Q: Hi , I committed myself to 72 hour hold for suicide. upon being released I found I was to sell my firearms .

I work in the pawn industry which the store I work in carries firearms . Am I still allowed to work ? This happened in California and I now live and work in Florida.

A: Apparently you were required to sell your firearms pursuant to Section 5150 of the California Welfare and Institutions Code. You might want to look up that statute; the link I found was bad.

If the statute prohibits you from possessing firearms, you need to look and see if there is a time period through which such prohibition applies. Also you need to determine if it applies to store employees such as yourself.

In any rate, the California stature would not apply to someone in Florida. The corresponding provisions of Florida law (the "Baker Act", and the criminal statutes) don't prohibit you from being in possession of a firearm. Federal law may, however, apply. For example, 18 U.S. Code § 922 provides that

"... (g) It shall be unlawful for any person—

...

(4) who has been ... committed to a mental institution;

...

to ship or transport in interstate or foreign commerce, or possess in or affecting commerce, any firearm or ammunition; or to receive any firearm or ammunition which has been shipped or transported in interstate or foreign commerce. ..."
