Conroe, TX asked in Workers' Compensation for Texas

Q: I have waited a week to find out the process for WC.

After I went and saw my own dr, I was told I had to go to the approved dr, waited a week to find out my dr was on the approved list, still no claim has been filed and now the owner of the company is trying to bully me. " I'm not saying you are going to loose your job but I need a full release that you can do your job before you can come back" "are you sure this is work related?"...can he do that?

A: Are you sure he has wc coverage? You can contact DWC to make sure. I will paste the website below. He can require a full release prior to your return to work but he cannot threaten action in the event you file a claim. Also if he has more than 50 employees within a 75 mile radius of your job site, the FMLA applies and he must keep your job open for 12 weeks in order for you to recover. You need to speak with a lawyer that handles these type of cases. Good luck.
