Q: I was involved in a bad accident almost a decade ago.

A person driving a truck for a company hit me head on. I've had multiple surgeries and permanent damage done to my foot. We sued the company and got some money, but now it looks like I might lose my foot. Can I sue the driver individually?

A: Without knowing the exact terms of the settlement no lawyer can answer this question. Who was a party to the settlement and what were the terms of the settlement? Did anyone seek the consent of any underinsured motorist insurance company at the time of the settlement? You really need to sit down with a lawyer to discuss the settlement and when you do bring with you the Release and any settlement documents the parties signed.

A: Not after 10 years. However if it was on the job it may be possible to reopen the case if you have had continuing care paid for by workers comp.Suggest you check with a member of the Iowa Assn for Justice--they give free consults.
