Q: In NV District Court how many days notice by mail required to give out of state client motion to withdraw as counsel?
The certificate of service attached to the motion attested client was sent notice on 10/21/16 but certified mail receipt indicates the motion to withdraw was not sent until 10/28/16. Attorney later rescheduled motion for 11/28/16, but did not refile or amend proof of service with the court. Client has not received official notice. A copy of it was sent to client on 11/7/16 by email. Can the motion be opposed in pro per by client for lack of adequate notice?
A: Yes but .....why not look to get counsel. A court will give you reasonable time but if you look like you're sitting on your hands the time will be shortened.
