Atascadero, CA asked in Patents (Intellectual Property) for California

Q: So if Powerhandz (registration #: 4971674) has a patent. Does it mean no one can create a weighted gloves for bball?

What exactly does this patent restrict?

A: The patent does not look right. US patent 4,971,674 is directed to Magnetron sputtering method and apparatus, and it has lapsed.

But to answer your question in general terms: If Powerhandz gets a patent on weighted gloves for bball, it would prevent others from making and selling such gloves without their authorization.

However, as you know, weighted sports equipment, including gloves, have been around for dozens or hundreds of years. You still could be able to continue to make and sell such weighted sports equipment despite the patent, because they can't protect something that has already been used. You just can't make and sell THEIR type of weighted gloves.

How do you know if the weighted gloves that you want to make is THEIR type of glove or not? You (or your lawyer) needs to take a look at the patent, specifically the claims.
