Bonneau, SC asked in Consumer Law for Wisconsin

Q: I had a vehicle illegally repossessed in the state of WI.

I had a vehicle illegally repossessed in the state of WI. I have since moved but I contacted the Department of Financial Institutions in WI about the matter and the finance company responded saying they would remove the negative information from my credit. They have since failed to follow up with their promise in the letter. I have recontacted the DFI and they have sent a follow-up letter with no response. What recourse do I have? The car was repossessed in WI but I now live in SC.

A: Whether the repossession was illegal and what remedies are available to you depend greatly on your particular circumstances. You probably need to get legal consultation with a Wisconsin licensed consumer attorney familiar with the repossession law to properly advise you of your legal options. If it is an illegal repossession, then there are significant remedies available. But don't delay. Some claims that may be applicable have a 1-year time to bring them in court.
