In Maryland, for most cases, you must be separated for 1 year prior to filing for the divorce. Separate means separate roofs, not separate bedrooms. There is no such thing as a legal separation. You can reach an agreement with your spouse prior to moving out, but that is not required. All that is required is that you live separate and apart.
