Q: Multiple fractured ribs. Dr trying to send me to work after two weeks. What can I do? We don't have light duty positions

I also have a floating cartilage the ER found after ambulance had to come. This was after seeing company dr. They have tried to send me back to work twice in less than two weeks. I'm in Baytown Texas and I don't know what to do. Still haven't heard from workman's comp either

A: Unfortunately your employer is probably in a "network"? A network is an entity of medical providers that is approved by the IC and employer. You have your choice of medical provider as long as you choose one of the doctors they have said you can choose. (What a deal!) If your employer does not have light duty available and the doctor released you to light duty then you should be getting wc benefits. If the doctor puts you on restrictions and your employer is willing to abide by the restrictions it will send you what is called a "bona fide offer" of employment. Very strict rules must be followed for the offer to be valid. You probably need a lawyer to assist you, or you can call DWC and ask it to appoint an ombudsman to "assist you". They assist you, not represent you and even DWC stats show lawyers have better success helping injured workers than the ombudsmen. But hey, the ombudsman help is free. Ombuddies are like a box of chocolates, you never know what you are going to get. Some are quite good some are...well something else? Good luck.
