Minonk, IL asked in Child Custody and Family Law for Illinois

Q: My ex is trying to get me to set up visitation for him and get it notorized without the courts. Is that legal?

I had an order of protection on him then he was sent to prison and when I renewed my o.p. i asked for visits to be removed with the reasons I had for it. They removed visits. I just want to do some homework so I know

A: Not sanctioned by the court means you will have difficulty enforcing it. Get a lawyer and make it legal.

A: It sounds as though your ex was not given visitation in the court papers. If so, was there a reason for that? Perhaps you want the court's input before he gets visitation.

Those papers may also say that any change to those papers has to be in writing. You and your ex can agree to any changes that you both agree on. But, again it depends on why he did not get visitation in the first place, or whatever visitation that he did get then.
