Miami Beach, FL asked in Real Estate Law and Landlord - Tenant for Florida

Q: Adding spouse as an occupant in Florida

For some reason I can't find an answer to this anywhere online. I hold a lease in Miami and my husband who used to travel between here and NYC now needs to move in with me as he will be here full time. He has bad credit and will certainly not get approved to be added to lease. Can my building legally refuse his access as an occupant even if he is willing to give them his information and do a background check that will definitely come back clean? Bear in mind that this does not violate max occupancy terms of the unit

A: But it depends upon the terms of your lease. If, for example, the lease says something like "nobody shall occupy the unit without the landlord's consent", the landlord can probably refuse such consent.
