Q: What does tenant will provide back property in same condition as given mean Does it include repainting is tenant painted

tenant painted walls with verbal permission of landlord, lease is coming to an end, does the above clause mean the house has to be repainted by the tenant before vacating the premises and if not repainted can landlord deduct from security deposit. The lease does not mention paint or nail holes repair etc..only" tenant will provide back property in same condition as given".

A: If the walls were green, for example, and tenant painted them red, I don't think the tenant has to pain them green again. If, however, the condition of the paint on the walls is less than a tenant would expect, then the "same condition" language would apply and tenant should re-paint. You are not clear as to whether nail holes are a problem.
