Q: Animal case? Bladder surgery results in 2nd surgery, Dr. Error. Damaged urethra causing near death toxicity leakage

Failed bladder surgery, results 2nd emergency surgery due to missed leakage into body cavity and distending abdomen. Tubing of throat improperly during surgeries causes cuts in throats causing stricture scars. After scaring, vomiting began and lots of weight loss. Internal med specialist was suggested and required Found esophagus was complete closed with stricture, which was not present in initial surgeries. It has cost an additional $20,000 in debt. Initial surgery cost was approx $2,000. 2nd surgery was free due to Dr. error. After each procedure with specialist req additional procedures would be needed as a follow-up with an additional painful stricture tear openings. Nov 2, 2016 until present with several more procedures until able to eat by mouth. Has to be peg tube fed through the stomach every 4 hours since the end of November and has had 6/7 total procedures. At no time prior to his bladder surgery, did he ever present sick or ill. He has been strong and healthy.

A: I am very sorry to hear about your post-operative difficulties. I have seen many instances where the surgery that was supposed to "fix the problem" leaves the patient worse off than he/she started. Your potential case presents a long list of issues that would best be sorted out by an experienced medical malpractice attorney. Most experienced medical malpractice attorneys work on contingency; meaning it costs you nothing unless a monetary recovery is made in your favor. I would be happy to discuss this further with you. Please feel free to contact me your convenience.

A: The problem is that you can only recover for the money you have spent. The law won't give you an award for seeing your pet go through that usually. Check with an attorney who is a member of the Md. Assn for Justice and handles veterinary cases. You'd also need to have an expert in veterinary malpractice to say that what the doctor did was wrong--not just that there was a bad outcome. That can be expensive.
