Hampton, VA asked in Workers' Compensation for Virginia

Q: Can my attorney accept and sign award areement without my consent? Can it be re opened? Is this legal?

Got hurt on job last year. Had surgery, was payed TTD for 17 weeks but the amount was wrong. Insurance never payed medical bills so I hired an attorney. Never met the guy in person and had only 1 phone conversation with him, only dealt with legal secretary. I handed over ALL medical bills, ALL of my pay stubs, ALL past and ongoing medical records and reports as I was still in treatment. Next week a mediation was scheduled but today I received a copy of an award agreement signed by my attorney, attorney of insurance and signed and entered by the deputy comissioner! I have neither seen nor agreed to anything in this agreement nor have I signed it. Just about everything is wrong. The "award" is for payment of medical treatment (good) and TTD payments (in the wrong amount) and thats it! There is no mention of lifetime medical ( I need to have my hardware removed) there is nothing for milage re embursement, no re embursement for out of pocket medication, nothing for PPD ( 5% rating).

A: You should speak with your lawyer in person for clarification.

If there are still benefits outstanding another claim may be filed.
