Chicago, IL asked in Personal Injury and Landlord - Tenant for Illinois

Q: What can you do when you notify your landlord of an Bed Bug Issue, and he refuses to do anything to treat the apartment?

Early December I notified my landlord of an bed bug issue. Since then the landlord has refused to do anything to treat the apartment. I have withheld rent, until this apartment is beg free. I also have done research on my end, and have sprayed to treat the apartment myself. So far negotiations through the landlord's lawyer have failed, and still to this day the apartment has not been treated. I have pics of bites, I was in the hospital for an allergy reaction to the bites. The only resolution is to leave the premises, throw away all my furniture, which needs to replaced by the landlord. Please advise me on what I should do further. I live in Berwyn, IL

A: I would highly recommend consulting with an attorney individually before doing anything further. Did you notify your landlord in writing and do you have receipts for your furniture you were forced to throw away? In any event, organize all of the information you have in your possession regarding this situation, including your lease, and consult with an attorney individually. A knowledgeable attorney will represent you in all aspects of the recovery process, and ensure you maximize your recovery. Furthermore, many of us offer free consultations, so it will not cost you anything to obtain a professional's opinion tailored to your specific situation.
