Reedley, CA asked in Workers' Compensation for California

Q: What do i do!?

I have a workmans comp case injury. Though it is now closed. I still have medical open. Therefore, my attorney still represents me, with helping get me seen by doctors or on the potential future medical settlement part. The point is, my attorney hasnt got me the help i need. Or the insurance hasnt. I haven't been able to see a doctor in over a year now for my physical injury! I was also diagnosed with depression & anxiety in 2012, then was reevaluated in 2014 by the same doctor. Was then diagnosed with PTSD & a worsened condition! I have not received help for it in 5 years! Nor have seen a doctor for the physical part of my injury. Its driving me INSANE! I dont know what else i can do. Can i please get a helpful response? I'd appreciate it so much! Thank you!

A: I do not understand your question or how anybody can answer it. I'll try my best.

What can you do? You can drop attorney and represent yourself on the management of your future medical. The Stipulation you signed (settlement docs) should dictate what body parts you get treatment for. In addition if your DOI is within 5 years and your condition has worsened you can file a petition to re-open. If your condition worsens you can be compensated for the difference (example: case stipped at 5 and now you are at 8. You can be compensated for 3% difference). Either way you can probably get more done on your own than your attorney since future medical is all that is left. Good Luck.
