Q: Can a state garnish wages for back taxes if you live in another state? And how can you get proof of back taxes owed?

I recently received a notice from the state of CT that I owe back taxes. I have lived in FL for several years, and have requested proof of the tax bill. I haven't received any proof, but just got a 30 day notice threatening tax warrants and wage garnishments. What can they legally do and how can I go about getting proof of what I owe and when the bill is from?

A: Yes, Connecticut can issue a wage garnishment order to the company you work for in Florida and will typically do so. You should contact CT DRS with the contact information provided in the tax warrant to discuss setting up a payment plan for the back taxes. Do not delay because DRS is typically fairly aggressive in collecting a tax debt after a warrant has been issued. The Tax Warrant would normally include information about the liability you owe, including the year (or years) you owe for and the amounts owed. If it does not specify this, you should be able to get this information when you call DRS. You can also ask them to provide you with "an accounting" for the tax balance: This would show the tax form filed, the amount owed with the form, any changes DRS made to the form, penalty and interest information and information on any payments made towards the liability. They may require you to make this request in writing.
