A: The workers Comp insurance company always request a list of all your past medical history. They do this to see if they can find any reason to either deny your claim or reduce the value of your claim by finding pre-existing injuries, disease or symptoms that may contribute to your current claim. At the end of the day, insurance carriers always try to reduce their exposure and liability in all claims in order to pay less on every claim. I suggest you consult with a experienced workers Compensation attorney immediately. The consults are always free. Good luck.

A: Yes you have to sign release if you want to pursue your case. It is a discovery right that defense is entitled too. The reason is that they want to check your medical history to determine if you had a previous injury to the body parts alleged. If so you will have what is called apportionment. You may say that you have not had an injury to those body parts but they want to do a medical investigation. If you do not have an attorney get one. Good Luck.
