Q: My spouse is on probation for dom. vio, we are together but lately he has become abusive again. Can I have is proba rev

He qualified for PTI but failed to complete the terms. He is now on full blown probation which is suppose to end in may but he hasn't paid the majority of his fines, has only completed 6hrs of the 80hrs of community service and hasn't completed any of the mandatory classes. He threw a bowl at Be and pushed me into a door last night. I want him to leave our home but he refuses too. I'm wondering if calling his PO would do me any good or not.

A: The short answer is you can't have his probation revoked but giving such evidence to his PO could easily result in revoking or even new charges.

I also recommend two things: (1) Contact a criminal defense attorney to understand the consequences of revoking and whether there are other solutions to the problems. In my experience, people are often surprised by the consequences of certain reporting and more surprised that they can't drop charges (only the state can). By contacting a criminal defense attorney you can educate yourself on everything and make the decision that is best for you.

(2) Contact a group that specializes in helping domestic violence victims. It's impossible to tell from what you have written what the dynamic is, but every person who is sensible should tell you that it can get very serious very quickly. If your spouse is on probation and you are seeking to have it revoked, the spouse could get very upset and then very violent. That is why everyone will treat it so seriously including giving the spouse jail time if that is what the government wants and the court agrees.

This is clearly a bad situation and I recommend you reach out for help from people trained to help people in wuch situations.
