Q: Can the father of my child stop paying child support if he doesn't get to see his child?
He lives in Michigan.
A: The father should not violate court orders. If he stops paying child support, legal interest will begin to accrue. If he believes that he is paying too much, etc., he should file for a request for order to change the amount, but that amount may not be changed if the circumstances around the order have not changed. You may need the help of the Department of Child Support Services to collect, and they can garnish his wages if he's working. If he's not working, he may be able to change the child support amount, but a thorough analysis is required. If he's not seeing the child, he may be ordered to pay more in child support because time with the child is a big factor. Of course it is difficult for him to spend time with the child due to distance, but that will not change a child support order unless a judge makes orders.
