Q: Child supp lowered if kids are teenaged(16y/13y) and don't require child care? & I have 2 kids with new partner (5y/3y)
I pay 1,000 a month to ex (per court order) since 2010. (Originally 700.00 a month but I opted to pay more because ex had a part time gig and I had no extra kids) now I've got 2 little ones with new partner that need attention and will need child care if my schedule changes with job. I cannot afford to continue to pay the same while still dishing out money for my 2 daughters from ex . (Example; school clothes for oldest & a bus pass every month and paying for both their cell phones). Not a dead beat dad and have always paid what im suppose to plus had them more then what I should because we (me and partner) love having girls when we go out on family outings ex:camping and or family visitations in other states. ) my 16 year old is very mature and has expressed feelings that she would like for me and their mom to have 50/50 custody. I think daughter should be able to travel to either parent without 1 parent refusing due to emotional issue. Ex: being angry that daughter wants to hangout.
A: Although paying more than guideline child support could pose some issues for modification, you may be able to change the child support amount. One strong fact is that your 16 year old has expressed an interest in spending a lot more time with you. You may need to file a request for order seeking a change in child custody, visitation and support. Your two little ones should spend more time with a teenager that wants to spend time, too.
