Q: Just married & thinking about buying a home. If I buy a home & place the title and deed in an LLC, does it insulate me
Will that action insulate me from divorce problems like the woman taking half of my assets.
A: No. And it has negative tax implications as you lose primary residence deductions. A prenuptial agreement does what you want.
A: It doesn't insulate you because the % ownership in the LLC would be marital property subject to equitable distribution. The other lawyer who responded was partially correct, a post-nuptial agreement (since you are married already) is what you need and to my knowledge you can still get the primary residence tax benefits even if it is an LLC so long as the LLC doesn't engage in any other business than holding the house. Reach out privately if you have any more questions.
