Berwyn, IL asked in Bankruptcy for Illinois

Q: Can an unsecured credit item included in a ch13 be paid in addition to the ch13 payment?

QUESTION - can we negotiate some sort of settlement of this line of credit and pay it while I am paying into it in the ch13 so that it can be resolved sufficiently for my spouse to open up a checking acct in other banks?

Or does she have to wait 5 yrs to open any bank accts - - in which case we would still have to pay her portion of the debt as my portion of this debt that I am liable for is a highly reduced number due to a minimal amt of assets?

DURING THE COURSE OF THE CH 13, can we settle w/ creditors along the way?

IMPLIED QUESTION: if this acct is settled, would the Ch13 payment be reduced accordingly since some of the payment goes to that acct? HOw would this be done? Would this be a part of the $4k fee for servicing a ch13 over the 5 yrs?

A: Spouse didn't file.

She is not restricted in what she can do.

Maybe she can negotiate for herself.
