Knoxville, TN asked in Workers' Compensation for Georgia

Q: False information on denial form

My benefits for compensation are being denied until a second opinion is given. However, the denial form had false information on it such as part of the body involved and treating physician are both wrong. I have been out of work for a month due to a neck injury. They claim benefits are being denied until further investigation because after I done the inital report of injury and seen the doctor; I wanted to see if it was just a pulled muscle before filing a claim. Approximately 6 months went by and my pain got worse so I filled a claim. The first doctor recommend 2 total disk replacements for 1 herniated and 1 bulged disks. Is this a battle that I could win if benefits are denied, given that I did the first report of injury, filled a claim within a year, and the false info on the denial form?
