Q: I was working with CDS LAWYERS in Irvine, Ca for a Mortgage modification. now they won't return my calls.

I have been working with CDS LAWYERS for about a year now trying to get a mortgage modification after my wife passed away. One of the first things the lawyer told me was that I should NOT have any contact with the bank and everything should go through them. I kept in touch with them about every two weeks to see if there was any progress. They asked for paper work and everything else for the modification. Then last week the bank called me and left a voice mail saying they received the paper work. I called the lawyers, but it goes straight to voice mail. It's been two weeks now and they haven't returned my calls or answered my emails. I paid them $ 3,500 a year ago. I last talked to the lawyer a little over two weeks ago and she said, they were still talking to the bank. Does it sound like I've been scammed or am I just getting paranoid ? I know New Jersey is No.1 in foreclosures. I'm trying to get this done as fast as possible, but they said, it takes time. What do you think ?

A: I am very sorry for the passing of your wife and having to deal with that, on top of being scammed. I have no clue why you would use any firm or company other than a licensed NJ attorney who specializes in Mortgage Foreclosure Defense, Complex Chapter 13 Bankruptcy and loan modification. This past week alone, I successfully resolved 3 cases, where my clients obtained mortgage loan modifications. You need a NJ attorney, who knows what the NJ Judges and lender's law firms are looking for and how to properly present it to them. A good quality attorney is someone who provides you will regular and constant communication. When I provide my clients my business card, it has my office number and my business cell phone number. When a mortgage loan modification is sought through the Bankruptcy Court's mortgage modification program, all documents are submitted electronically through a the Bankruptcy Court's portal and are time and date stamped. Lenders cannot play the games they do in State Court. There are penalties for Lenders who do not comply with the rules and regulations of the Bankruptcy Court's mortgage loan modification program. A: Listen to Attorney Leonard Boyer and he is giving you great advice. Nothing is worse then a lawyer who doesn't return calls it's even unethical and you should report it to the NJ ethics committee.
