Huntley, IL asked in Employment Law, Personal Injury and Workers' Compensation for Illinois

Q: I need help with employer long-term disability. Is there someone who can help me dealing with the LTD insurance company

I have a multitude of medical conditions, ankylosing spondylitis, Sjogren’s syndrome, severe fibromyalgia, degenerative joint disease, asthma, sleep apnea, etc. I applied for LTD in July 2015. I was denied in October 2015. I appealed the decision 2 more times and just received word that my case was approved. However, today I received the final approval letter and I see that they are basing my claim on testing done by a neuropsychologist who reported that I had significant cognitive impairment due to lack of sleep, chronic pain, and multiple medications. Because the insurer was basing of this, one report, and not all of my other medical records, they determined they would approve the claim and classify it at mental illness which only qualifies for two years of benefits. Ssince I applied in July 2015 and the elimination period ended October 8, 2015, that I would only be eligible for benefits until October 8th of this year. Then what would I do? Do I have any recourse?

A: You need to search for an attorney who specializes in employment benefits. You should have done this in 2015. If you search for "employment benefit attorney McHenry County"you should find someone close to you. If not, search for "employment benefit attorney Chicago." There are several good firms in the City who do this work, exclusively.
