Q: my workman comp pymts stopped I was injured January 26th, 2015. It's March 27th,2017 hearing day.

we were instructed to be at a hearing in front of the arbitrator, our attorney was rude, we were told by the company being held responsible that our time slot was canceled via an email which had disappeared. Our attorney says our case is a lose lose situation and if we are unhappy to go elsewhere. Living with zero income for 2 years has come to the point of almost losing our home. Our attorney says we will be lucky to gey money within the next 10 yrs.What should we do?

A: Since you are represented by counsel, you should direct all questions and concerns directly to your attorney. If you are not satisfied with your current attorney consider hiring a new one, although it may be a challenge at this point in time because the new attorney will have to split the legal fees (likely 20% of the total recovery) with your current attorney.

A: When you are represented by counsel, my first inclination is to tell you to demand a sit-down meeting. In light of the facts that you have had no income for 2 years, presumably no medical care, and the fact that he told you not to expect money for 10 years, makes me say: GET ANOTHER ATTORNEY!!! NOBODY can go without income for 2 years. At the beginning of a case, you can GUARANTEE a Decision within 6 months but it's a great deal of work. Call an experienced Workers' Compensation attorney and discuss your injury, your employer, and what the attorney can or cannot do for you. It is deplorable that your present counsel has not respected you enough to explain the process and what he is doing.
